NCR: Structural problem in flat? Why you must keep eye on 5-year rule

GHAZIABAD: The cave-in at Chintels Paradiso on February 10 that killed two residents of the Gurugram condominium has led to a chorus of demands from residents across NCR for structural assessments of buildings as well as questions about the redress mechanism when an apartment shows defects but the builder doesn't respond. UP-Rera chairman Rajive Kumar told TOI on Tuesday the law provides for a process to seek redress and hold a developer accountable.

"There is an existing rule that under the provisions of Rera, if there is any structural deficiency in a building within five years of the occupancy certificate being issued, a complainant can issue a notice to the promoter, who is liable to reply and attend to the problem within 30 days," said Kumar.
