Special counsel Jack Smith has formally indicated that he is appealing the decision to throw out the classified documents indictment against Donald Trump. The special counsel team filed a notice of appeal on Wednesday, just two days after US District Judge Aileen Cannon dismissed the prosecution. This move comes well ahead of the 30-day deadline the prosecutors faced for bringing the appeal.
The appeal will be reviewed by judges from the 11th Circuit Court of Appeals, based in Atlanta. The two-page filing from Smith’s team did not specify whether the prosecutors will seek to expedite the appeals process.
In her ruling on Monday, Cannon stated that she found Smith’s appointment as special counsel to be unconstitutional, leading to the dismissal of the case against Trump.
