Rep. Fitzgerald Questions Attorney Hur On Classified Documents

Then-U.S. Attorney Robert Hur speaks to the media

During a recent hearing, Rep. Scott Fitzgerald questioned attorney Robert Hur regarding his report on the President's memory and the handling of classified documents at the Penn Biden Center. Hur clarified that his report did not conclude the President was senile and focused on the President's memory gaps in relation to intent regarding national defense information.

Rep. Fitzgerald then delved into Chapter 14 of the report, highlighting the highly classified documents found at the Penn Biden Center, many originating from Mr. Biden's West Wing office. The investigation revealed that the boxes containing these documents were moved hastily between offices unauthorized to store classified information.

When the boxes were eventually discovered more than five years later, it was President Biden's personal counsel, Patrick Moore, who found them. Moore, however, did not have an active security clearance at the time. The report also mentioned discrepancies in statements made by Moore and Mr. Biden's executive assistant regarding the locking of a closet where the documents were stored.

In total, nine documents totaling 44 pages with classification markings were found at the Penn Biden Center. Despite this, charges were declined due to the inability to prove willful retention of the documents beyond a reasonable doubt.

The hearing shed light on the handling of classified materials and raised questions about security measures at the Penn Biden Center. The exchange between Rep. Fitzgerald and Attorney Hur provided insight into the investigation's findings and the challenges faced in determining intent and culpability in such cases.
