Renfrew man who took extra shift at work fined for being out of his house after 7pm

A Renfrew man who took an extra shift at work was fined for being outside his home after his curfew hours.

Ross Faulds, 41, took an extra shift at Luna Rossa in Renfrew’s Canal Street on Saturday as his manager had “been let down.”

Faulds had been placed on a curfew condition on August 27, last year that kept him within his home address between 7pm and 7am each day.

Paisley Sheriff Court heard Faulds, of Edward Avenue, took an extra shift to “deep-clean” the kitchen at the bistro and didn’t get back home until after 11.30pm.

Faulds claimed he was assaulted while walking home and called the cops to report the matter – but this alerted to him being outwith his home after his curfew.

Fiscal depute, Amber Feeney told the court: “Around 11.50pm, police attended at Fauld’s home address regarding a separate matter.

“Officers viewed CCTV from Luna Rossa regarding the separate matter and saw the accused within the premises with other staff between 9.30pm and 11.24pm.

“The accused went outside to smoke, returned inside and then walked away from the property down Canal Street towards his home.

“After viewing CCTV, officers cautioned and charged the accused for breaching his curfew condition, and he made no reply.”

Kevin Brady, defence agent told the court the reason Faulds called the police was due to being assaulted on the way home.

Mr Brady added: “He was working in the restaurant as a chef.

“His manager had been let down by another member of staff and he took the extra shift to deep-clean the kitchen.

“He normally works lunch time shifts but took this shift for extra money as he has substantial money worries just now.

“When he was walking home, he was and this is when the police came to light that he had breached his curfew.”

Sentencing, Sheriff Laura Mundell said: “This is a serious matter as you remain subject to the curfew.

“I’m going to deal with this today by way of a fine.”

Sheriff Mundell fined Faulds £210 and ordered this to be paid at £5 per week.
