Redfield man jailed after using a mate's mobile phone

Borrowing a mate's phone cost a Redfield man a prison sentence. It so happened Craig Fricker was not allowed to have a phone not registered to him under a court order.

Fricker, 36, of Whitehall Road, pleaded guilty to breaching a Criminal Behaviour Order (CBO). He appeared at Bristol Crown Court via video link from HMP Bristol for sentence today (Friday, March 11).

The Recorder of Bristol His Honour Judge Peter Blair QC jailed him for six weeks. He told Fricker: "You admitted possessing an unregistered phone. You explained you were borrowing it very near the end of the period of the order."

Robert Yates, prosecuting, said Fricker was under a CBO when, on February 10, police observed him appearing to be involved in a transaction in the street. Fricker told them he was buying drugs, the court heard.

Police who visited his home found he had a mobile phone not registered to him, in breach of the CBO which was made from April 2017 to April this year. Fricker admitted the phone belonged to a friend.

Mathew Comer, defending, said his client entered an early guilty plea and had spent a month remanded in custody. He invited the judge to impose an eight-week jail term to enable his client's prompt release.

Criminal Behaviour Orders are aimed at tackling the most serious and persistent offenders where their behaviour has brought them before a criminal court. CBOs include prohibitions to stop the anti-social behaviour, and may also include requirements to address the underlying causes of the offender's behaviour.
