Prosecutor David Harbach emphasized to Judge Aileen Cannon that ensuring the safety of the community is paramount and overrides First Amendment concerns.
Harbach highlighted the potential threats, harassment, and attacks on officials by Trump supporters as a reason to consider limiting Trump's speech. He argued that curtailing Trump's speech could help prevent such actions and protect the community.
The prosecutor also pointed out that the court has the authority to protect the community and control a defendant, even someone as high-profile as Trump, while awaiting trial outside of a jail cell.
