Proposed CMS Rule Would Require ACA Subsidy Checks Before Payments Begin with 2028 Plans, Not This Open Enrollment

The Centers for Medicare and Medicaid Services has proposed requiring Affordable Care Act marketplaces to verify key eligibility details before people receive premium subsidies. The rule was announced October 23, just over a week before open enrollment for 2027 coverage begins November 1.

The timing may confuse, but the proposal would not change this enrollment season. CMS says the requirements would generally take effect with eligibility decisions for 2028 health plans, and only if the rule is finalized.
