Preventive detention of student leader: HC quashes Kerala govt's order

KOCHI: The Kerala High Court on Tuesday quashed the preventive detention of a Kerala Students Union (KSU) leader Bushar Jamhar under Kerala Anti-Social Activities (Prevention) Act.

A division bench comprising justices Alexander Thomas and Sophy Thomas issued the order after considering a petition (WP-Crl. No. 1042/22) filed by the leader’s mother Jasheela TM. Bushar is KSU’s Kozhikode district secretary and a law student. His mother had alleged that the preventive detention is due to political animosity.

Through the judgment, the court quashed and set aside the detention order issued by Kozhikode district collector/district magistrate on June 27 this year, which was confirmed by the home department on October 21st this year. The court ordered the superintendent of Viyyur central prison to forthwith release the detenu and set him at liberty if his further detention is not required in connection with any other cases. Issuing a gist of the directions, the court said it will deliver a detailed judgment soon.
