The pre-trial hearing for accused child molester and alleged Cain Velasquez shooting target Harry Goularte has been granted a continuance.
At a hearing Tuesday at the Santa Clara County Hall of Justice in San Jose, Judge Cynthia A. Sevely approved a request by the district attorney’s office and representative Robert Philbrook to continue the matter until Nov. 14 in order for a longer allowance of discussion time.
Goularte faces one felony count of lewd acts with a minor under the age of 14. The alleged victim is Velasquez’s 4-year-old son, Cain Jr. In June, Goularte pleaded not guilty to the charge.
According to investigators, Goularte sexually assaulted Cain Jr. at a daycare he resided at run by his mother. The child told investigators Goularte took him to the bathroom and touched his genitals. The child said it happened “100 times” and that other children were seen going into the bathroom with Goularte.
Goularte was arrested and released on bail in February. Days later, Velasquez was arrested and charged with attempted murder among other charges after he allegedly pursued and shot at Goularte and his family. Velasquez has remained in custody since his arrest, though attorney Mark Geragos filed a writ appeal in July that aims to get bail – something that’s been denied three times by Judge Shelyna Brown.
In August, Velasquez pleaded not guilty to charges and is currently set to have a pre-trial hearing of his own Oct. 17. Velasquez’s wife also filed a civil lawsuit against Goularte, as well as Goularte’s family and its associated businesses. Preliminary civil discussions are ongoing with a date on the civil docket scheduled for March 28, 2023.
