A man who was left with a fractured nose, broken wrist, a damaged elbow as well as other wounds to his face and body in a motorcycle crash in Ibiza has been awarded £58,000 compensation. Khaled Muwahed, 22, spent eight days in hospital after the collision four years ago.
Khaled was a university student at the time and rented the bike while on holiday with a friend. However Khaled, an experienced rider, was knocked out when a car coming out of a side road hit him, his lawyers said.
The driver stopped and onlookers came to his aid, calling the police and an ambulance. Khaled was said to be in agony and covered in blood, reports the M.E.N.
His fractured nose needed immediate surgery and he needed a further operation on his fractured left elbow back in the UK. Khaled also suffered a number of wounds to his face which required stitches and was covered in bruises to his legs, knees and back.
Once he was deemed fit enough, he was able to fly back home to Manchester. He said: "This has been a very difficult three years while I have recovered from the effects of my accident."
While in Ibiza, he contacted Cheadle-based no-win no-fee firm Holiday Claims Bureau to act on his behalf and his case was led by the company's head of travel litigation, Michael Walker, a partner at the firm.
Mr Walker said: "These are very complex cases, mainly because the accident happened in Spain and so Spanish laws apply. This particular case was made more difficult due to Brexit taking place whilst it was ongoing, meaning court proceedings were quickly issued in this country to avoid any possible jurisdictional issues.
"Our team have extensive experience in handling accident abroad cases and have developed legal contacts throughout the world meaning we were able to instruct a Spanish lawyer to advise us on the issues of liability and the value of the claim."
The case included medical evidence from an orthopaedic surgeon, a spinal surgeon, a plastic surgeon, an ear nose and throat specialist and a clinical psychologist.
The firm said Khaled was continuing to suffer with difficulty breathing as a result of his nose fracture and his nose was 'deviated' as a consequence of the accident. An interim payment of more than £12,000 was first secured to allow Khaled to undergo a 'septorhinoplasty' procedure privately. It improved the appearance of Khaled’s nose and his breathing, according to the firm.
A final settlement of £58,000 was agreed between the parties.
Mr Walker added: "This is a significant settlement for Khaled and will enable him to move on from this terrible experience during an important time in Khaled’s life whilst he was studying at university. We have been able to secure funding for and arrange the surgery he required, and we hope he can now look forward following this terrible accident."
Khaled said: "Michael and the team at Holiday Claims Bureau supported me every step of the way, arranging medical reports and treatment for my injuries. This has been a very difficult three years whilst I have recovered from the effects of my accident and I’m pleased with the help and support I’ve received during this time."
