MUMBAI: MahaRERA in a recent order asked a landowner in a Palghar-based project to take over the project, after the promoter abandoned it after collecting payments from around 150 flat and shop allottees. The builder had completed just 20% work on site. An association of allottees of the project requested MahaRERA to replace the builder and allow the landowner to complete the project. The MahaRERA said that both the respondents are promoters as per RERA and if the builder is unable to complete the project, so the landowner is under obligation as a promoter to complete it.
As per complainant Vishal Mutreja, secretary of the association of allottees, a development agreement for the luxury empire township phase-II and luxury empire township phase-III project at Kambalgaon in Palghar District, was signed in 2010 and later terminated. Of the 500 units in the project, 150 units were allotted and the allottees had paid the booking amounts.
