A Lexington City Council member arrested at an A-T and T store March 10th pleaded not guilty to third-degree criminal trespassing, menacing and resisting arrest. Tayna Fogle was arraigned Friday in Fayette District Court, with about two dozen supporters in the courtroom. Her attorney, Daniel Whitley Senior, said he’d hoped the charges would be dismissed.
“Unfortunately, wasn't. We just look forward to presenting her case in front of the tribunal in the jury system, and we'll have confidence we’ll end up getting her found not guilty.”
Fogle and Whitley took a few questions from the news media. This one was directed to Fogle and answered by Whitley.
“In retrospect, is there anything you would have done different Sunday?”
“Of course not. I think that anybody in this situation, definitely dealing with the phone companies in the bureaucracy and hard to get a hold of a live person. When you're facing a charge of fraud, that you have someone fraudulently charged a bunch of things in your account, I think any citizen will go to the actual local business to figure out what's going on.”
Fogle’s pre-trial conference is scheduled for April 16th.
