ATLANTA — State lawyers told a federal appellate court Friday it should let Georgia's stalled abortion law go into effect after the U.S. Supreme Court's recent ruling that overturned Roe v. Wade.
The June decision from the Supreme Court ended a nearly 50-year precedent asserting the constitutional right to an abortion and leaving the procedure up to each state, and Georgia's lawyers said those challenging the law no longer have a case.
Within hours of the Supreme Court's decision in a case challenging a restrictive abortion law in Mississippi reversed the 1973 ruling, the 11th Circuit Court of Appeals told lawyers they had 21 days to file legal briefs that "address the effect, if any, the Supreme Court's decision in Dobbs v. Jackson Women's Health Organization has on" on the Georgia law.
