'Judicial misconduct': Litigant can't demand in-house inquiry, says Kerala HC

KOCHI: A litigant cannot file a petition demanding in-house inquiry regarding alleged judicial misconduct of a high court judge as such inquiry is not a law but the discretion of the chief justice, a division bench of the Kerala High Court has held.

A division bench comprising justices AK Jayasankaran Nambiar and Mohammed Nias CP considered appeals (W.A. Nos. 1639 and 1640 of 2021) filed by Mathew Z Pulikunnel, who was evicted from a demolished flat at Maradu. A single bench had declined his plea for initiating proceedings against a former judge and a sitting judge of the high court as per the in-house procedure adopted by the full bench of the Supreme Court to deal with judicial misconduct of judges of the apex court and the high courts.
