Judge says dad who threw nine-month-old son across room suffered 'momentary lapse'

A dad shoved his partner after throwing their nine-month-old son across the room.

James Endean, from Truro, Cornwall, had previously spent time in custody for attacking his former partner.

The judge described hurling his baby across the room as a “momentary lapse” of regard for the child’s safety, Cornwall Live reported .

On September 23, last year, the 22-year-old got into an argument with his partner where he accused her of not doing enough for their nine-month old son.

He began shouting, kicking and punching things and even after heading out for a cigarette, the argument continued.

Endean told his partner she couldn’t go to work that day and that she had to stay and look after the child.

His petulant behaviour continued and he kicked a TV and TV stand in front of their crying baby, the court heard.

Michael Brown, prosecuting, said his partner attempted to diffuse the situation and offered to take care of their son.

It was then Endean picked up their child and hurled him across the room.

Mr Brown said: “The defendant picked up their son and threw him two metres to her. Fortunately she was able to catch him to stop him from falling to the ground.”

Endean, who has attacked the same woman previously, then pushed his partner back as she held the child, causing her to stumble.

Neighbours eventually called 999 and the police arrived.

Endean’s behaviour was described as “a brief but deliberate disregard for the welfare of his son”.

Representing Endean, Katie Churcher said: “He completely lost his temper and lost all sense of judgement. He regrets it deeply but has changed his life, his situation and his attitude.”

She went on to add that Endean welcomed the restraining order and wished to have no contact with his ex.

He had sought help for his mental health and stopped smoking cannabis, as well as moving in with his grandparents and working full-time at a fast food restaurant, Miss Churcher added.

Sentencing Endean, Judge Anna Richardson spoke of how the whole incident took place in front of a child and said: “If you throw a small baby you run a high risk of causing serious damage. It was a deliberate disregard for the child’s welfare but was a momentary lapse.

“You have already suffered the consequences of your actions and lost the care of your children. You are beginning to mature and understand you need to change your lifestyle and attitude.

“You suffered your own childhood trauma and I believe work can be done with you to ensure you stop offending in this way.

“Now that particular relationship is over, your risk can be managed in the community. You have obtained full-time employment and are doing well in that. I’m not going to interfere with these stabilising factors.”

Endean was given a 10-month prison sentence, suspended for two years. He must complete a building better relationships programme and rehabilitation activity requirement.

A restraining order was put in place and he must pay his former partner £450 in compensation.
