Johnstone man threatened "to murder" his mum after binge-drinking

A Johnstone man who was sick on his front door step after ‘binge-drinking’ threatened to murder his mum has been slammed for a sheriff for his disgraceful behaviour.

Daniel Rock, 26, threatened to murder his mum after he had spent the night binge drinking resulting in her calling the cops ‘terrified’ for her safety.

Rock’s mother, Josephine, was forced to flee her home and run to a neighbour’s for safety on March 28 after the terrifying ordeal.

Prosecutor, Amber Feeney, told Paisley Sheriff Court: “Around 11pm, on March 28, the accused returned home in an intoxicated state.

“The witness Josephine Rock was awoken by the noise made by the accused.

“The accused went upstairs to Josephine Rock’s room and began to speak to her in relation to a sore arm he had previously injured.

“Josephine said she would speak with him later as she wanted to go back to sleep and the accused’s temper changed immediately.

“He began to act aggressive and shout and swear explaining that she didn’t care about him and he then went downstairs to the kitchen.”

Court heard how Rock was making noise in the kitchen which caused his mother to go downstairs to check on him.

Ms Feeney added: “Rock continued to shout and swear and was highly volatile and behaving in an aggressive manner and he stated that his mum hated him.

“He then went out into the front garden and lay down on the front step and vomited before shouting, ‘see when I can get up, I’m gonna murder you.’

“Josephine was terrified, shut the door and returned to the kitchen.

“He opened the door and continued his tirade of abuse.

“Rock then picked up a bottle of alcohol and began swinging it above his head shouting in an aggressive manner, ‘I f*****g hate you. You better get the police here before I murder you.’

“Josephine contacted the police but the accused followed her upstairs and she terminated the call for her safety.

“She then saw an opportunity to by-pass Rock and ran downstairs and out of the house towards a neighbour’s house and contacted the police.”

Court heard cops attended the Tower Road property and were refused entry for around 30 minutes with officers noting he was “extremely irate and behaving in an erratic manner” before he eventually allowed them entry.

Defence agent Charlie McCusker explained Rock had been “binge-drinking” on the night of the incident and had

Mr McCusker added: “To say he was squirming about what he’s done to his mother would be an understatement.

“He has bridges to build and he accepts that and he recognises he needs assistance with his alcohol.”

On sentencing, Sheriff Lindsay Kooner said: “You don’t need me to tell you that this was absolutely disgraceful conduct towards your mother.

“You caused fear and alarm to her but she does wish to have contact with you.”

Sheriff Kooner placed Rock under supervision of the social work department for 15 months and ordered him to carry out 120 hours of unpaid work in the community within 12 months.

A review hearing was set for August 18.
