JAIPUR: JMC-Greater commissioner on Friday stopped the corporation’s property attachment proceedings for non-payment of a penalty levied by the court in a case of wrongful termination in 2015.
The commissioner handed over a cheque of Rs 50,95,000 to the team of lawyers, court scribe, and a representative of the NGO, Nidan, that had filed a case against the corporation, at the Lal Kothi office, to get the attachment proceedings stopped.
Lawyer Yalp Singh, who was a part of the attachment proceedings, said, "We have received the original amount of the award, which is satisfactory as per the rules. The commissioner had sought time to seek guidance from the court on the amount of interest which is still pending and penalty, due to which the attachment proceedings have been stayed."
In 2007, Nidan NGO was given the contract of cleaning in Vaishali Nagar, Chitrakoot, and Hanuman Nagar of the Civil Lines Zone area of the corporation.
However, the civic body removed the NGO after one-and-a-half years following which the NGO filed a claim. On this, the arbitrator issued an award of Rs 50.95 lakh in favor of the NGO in 2015.
Against this, the municipal administration had filed a plea in the commercial court, which was rejected by the court in 2019. Despite this, the municipal administration did not pay the amount to the NGO. On this, Commercial Court Number 4 issued a warrant of attachment, giving notice of about Rs 2.43 crore for not depositing the principal amount and interest amount. The corporation has asked for some time to look into this matter.
