Highway Code petrol rule could see drivers with £100 fines

Motorists are being warned over a Highway Code rule that could see them hit with a £100 fine.

Drivers who let their car's fuel gauge drop into the red risk not only damaging their vehicle, but a hefty fine and penalty points, according to the AA. It comes after one member, who caused an obstruction on the road after running out of fuel, was recently hit with a £100 ticket from police.

The same rules apply for those with electric vehicles, who allow the battery to run flat.

The AA said it attended more than 10,500 breakdowns last year where members had run out of fuel or electrical charge. It believes this may be caused by motorists delaying filling up due to high fuel prices and the cost-of-living squeeze.

Running out of fuel, or charge, itself isn't illegal. However, motorists can be fined a minimum of £100 and three penalty points if their car obstructs the road as a result of an avoidable breakdown, or if running out of fuel is deemed to result in careless or dangerous driving.

If a vehicle causing an obstruction is found to be at fault for a collision, the penalty can be more serious.

Rule 97 of The Highway Code states: "Before setting off. You MUST ensure that you have sufficient fuel for your journey, especially if it includes motorway driving."
