Harvey Weinstein is set to be arraigned in Manhattan on a new indictment charging him with up to three additional sex offenses. His lawyer confirmed that the former movie mogul will appear in court in person to address the latest legal challenges after missing a hearing due to emergency heart surgery.
The Manhattan District Attorney's office revealed that a grand jury had returned a new indictment charging Weinstein with previously uncharged offenses. The specific details of the indictment will remain sealed until Weinstein's arraignment.
Prosecutors disclosed that the grand jury heard evidence of alleged assaults at various locations, including the mid-2000s at the Tribeca Grand Hotel, a Lower Manhattan residential building, and in May 2016 at a Tribeca hotel.
Meanwhile, Weinstein is awaiting retrial in his #MeToo case following the overturning of his 2020 conviction earlier this year by New York's highest court. The retrial is scheduled to commence on November 12, with prosecutors aiming to include the new charges in the proceedings, a move contested by Weinstein's legal team.
Weinstein's lawyer expressed uncertainty regarding the specifics of the new charges, as the indictment remains sealed. Weinstein has consistently maintained that any sexual activity was consensual.
Following emergency surgery to address fluid around his heart and lungs, Weinstein has been hospitalized at a Manhattan facility. A judge recently ruled for Weinstein to remain in the prison ward at Bellevue Hospital instead of being transferred back to the infirmary ward at Rikers Island jail complex.
The Court of Appeals in New York vacated Weinstein's conviction in April, citing unfair allowance of testimony based on allegations from other women not involved in the case. Once a prominent figure in Hollywood, Weinstein co-founded Miramax and The Weinstein Company, producing acclaimed films such as 'Shakespeare in Love' and 'The Crying Game'.
