The US Department of Homeland Security has expanded the 9/11 Response and Biometric Entry-Exit Fee to more H-1B and L-1 petitions, including extensions where a foreign worker continues with the same employer. But the additional $4,000 or $4,500 charge does not apply to every company sponsoring an H-1B or L-1 worker.
The final rule, which takes effect on September 9, 2026, requires covered employers to pay the fee on all qualifying H-1B and L-1 extensions, regardless of whether the separate fraud prevention and detection fee applies.
