A recent ruling by Fulton County Superior Court Judge Robert McBurney has mandated that Fulton County District Attorney Fani Willis’ office must provide a conservative watchdog group with documents related to its 2020 election interference investigation. The conservative nonprofit organization, Judicial Watch, based in Washington, DC, had filed a lawsuit after Willis initially denied having responsive records from their Georgia Open Records Act request filed last year.

Judicial Watch, known for its Freedom of Information Act (FOIA) lawsuits, has been pursuing information on what it terms as “prosecutorial abuse targeting Trump.” The court order requires Willis to conduct a diligent search for relevant materials within five business days.

This legal development marks a significant outcome, as Judicial Watch President Tom Fitton highlighted that it is the first instance where a government official has been found in default for failing to respond to an open records lawsuit. Fitton expressed the organization's anticipation in obtaining documents that may shed light on alleged collusion between Willis’ office, the Biden administration, and Nancy Pelosi’s Congress in what Judicial Watch perceives as a biased prosecution against Trump.

The initial open records request by Judicial Watch was triggered after former President Donald Trump and multiple co-defendants were indicted in Fulton County in August 2023 for their involvement in attempts to overturn the 2020 election results. Subsequently, Trump and others faced indictments in Georgia, although the legal proceedings could face challenges following Trump's reelection.

Willis’ office has not yet responded to requests for comments regarding Judge McBurney’s order. The court’s decision underscores the importance of transparency and adherence to open records laws in legal proceedings involving high-profile cases and political implications.
