The family of P'Nut, the internet-famous squirrel killed last month, is gearing up to avenge his death by suing New York's Department of Environmental Conservation for allegedly fabricating evidence to justify why their beloved pet was "executed."
On Wednesday, Mark Longo and Daniela Bittner started the process of filing a lawsuit against the state in which they claim an agent lied about being bitten by P'Nut to force a rabies test.
"It is further submitted that even if an agent was in fact bitten, killing P'Nut would still be unnecessary, unjustified, improper, and illegal," the claim read, according to Dexerto, "it is further submitted that there is no claim that Fred the raccoon bit anyone, and thus, the killing of Fred was unnecessary, unjustified, improper, and illegal."
The claim further alleged Longo and Bittner were denied due process because P'Nut was illegally seized and they only learned about his death after it was done and reported by media outlets.
They also took issue with how P'Nut was put down, claiming he was "executed, not euthanized."
Additionally, Longo and Bittner claimed their home was damaged during the raid. It is unclear what damages they are seeking from the lawsuit.
