Edinburgh pizza chef raped woman on Christmas Day while out on bail

A former Edinburgh pizza chef who raped a woman on Christmas Day while on bail as he awaited trial for another serious sexual assault charge has been convicted for a second time.

Lee Ibbotson ignored his victim’s pleas to ‘stop’ during the horrific incident between December 25 and 26 in 2019.

In documents submitted at the High Court in Glasgow, Judge Lord Summers deemed the 26-year-old as “presenting a high risk of reconviction for sexual offences”.

Ibbotson, who previously lived in the capital’s Duddingston area, was jailed for five years in October 2020 after preying on a woman unable to provide consent “due to her level of intoxication”.

He has now been ordered to spend another six years behind bars after the end of that term following the conclusion of the case on April 1.

The court heard how Ibbotson’s victim initially gave consent for sexual intercourse, but was finding it “painful” and asked him to stop.

She told him she “didn’t wish to continue” but Ibbotson “ignored” her and continued, aggravated by the use of ‘moderate’ force.

The woman later reported the incident to police - less than a year before he was convicted of his first offence.

In his judgement, Lord Summers wrote: “In 2019 you were two and a half years older and were therefore more responsible for your actions.

“I acknowledge that the facts of this case differ from the previous conviction. I note that the complainer had initially consented and that you were engaged in sexual intercourse when consent was withdrawn.

“Since the second offence was committed before your conviction for the first offence that this is not a case involving re-offending in the usual sense of the word, albeit you were on bail when the second offence occurred.

“You have been assessed as presenting a high risk of reconviction for sexual offences under reference to static factors and a moderate risk having regard to dynamic factors.”

Lord Summers rejected a Criminal Justice social work report which suggested an extended sentence, adding he had taken into account Ibbotson’s “troubled upbringing and steady work background”.

He had already been placed on the sex offenders’ register but was told he would be subject to the requirements of the order for an “indefinite period”.

Lord Summers added: “In these circumstances I sentence you to six years imprisonment.

“Of that total I apportion three months to the bail aggravation and three months to the aggravation under the Abusive Behaviour and Sexual Harm (Scotland) Act 2016.

“This sentence will run consecutively to the sentence of imprisonment that you are currently serving.”
