DUP councillor fumes as Garda car allegedly spotted in Tyrone miles from Irish border

A DUP councillor has questioned why a Garda car was so far from the Irish border, having allegedly been spotted in Tyrone.

Maurice Devenney claims the Garda car was observed travelling on the Lurganboy Road on the northern side of the border in the last few days and was "almost into Castlederg".

He now wants answers from either the PSNI or An Garda Siochána, while another politician has written directly to Garda Commissioner Drew Harris.

He told DonegalLive: "I have spoken to PSNI regarding it and they have informed me that if a car does cross into a different jurisdiction, there is a reporting mechanism if a mistake has been made.

"I can understand 100 yards or so when you realise you're not in your own territory but to be almost near Castlederg town, that's a long way from the border.

"I'm just raising concerns as to how this happened and what was the need for the garda car to be in that area."

West Tyrone DUP MLA., Tom Buchanan, has also written to Garda Commissioner, Drew Harris, on the matter, telling the same publication: "This incident needs to be fully investigated, as it was well within the border.

"I have written to the Garda Commissioner requesting a full investigation.

"These things must be fully investigated, and my colleagues on the Policing Board will be questioning the Chief Constable on this particular issue as well."

Gardai are allowed to carry out work across the border, as are the PSNI. Legislation exists which allows each jurisdiction the ability to treat and deal with a specific range of offences committed in the others jurisdiction as if it had occurred in their own.

In Northern Ireland the legislation is the Criminal Law Act 1975 and in the Republic of Ireland, the Criminal law Jurisdiction Act 1976. Prior approval of Senior Police for such a request would be normal practice.
