A man was attacked because he was considered to be "littering" as he stuck up posters on a shop. Philip Barber shoved Hardik Patel in the upper chest area, grabbed his collar and pulled him outside Select and Save, in Arnold Road, near Bestwood, on August 24.
Nottingham Magistrates' Court was told on Friday (September 30) the posters had an adhesive backing and Mr Patel and another were dropping the peel from the sticky part on the floor. Barber, 55, of Gainsford Crescent, Bestwood, took exception to this and considered them to be littering.
Barber looked agitated, was acting aggressively, and launched the attack before he left in his car to drive home. But police tracked him down and conducted a breath test which showed he had 50 micrograms of alcohol in his breath, over the limit of 35.

Barber pleaded guilty to drink-driving and assault, receiving a £207 fine on each offence. A compensation order was made to pay the victim £50, as well as paying out £164 towards a victim surcharge and prosecution costs of £85. He was given a 12-month driving ban.
