The Supreme Court on Friday stayed the demolition of the famous Curlies beach shack in north Goa in one specific survey number.
"There shall be a stay of demolition with respect to structures standing on Survey No.42/10 subject to the appellant not undertaking any commercial activity in or with respect to the structure," a Bench led by Chief Justice U.U. Lalit ordered.
The stay order was based on an appeal filed by Linet Nunes against a National Green Tribunal order.
The stay order came even as the authorities had just begun to raze the building for violating the Coastal Regulation Zone.
The restaurant was in the news recently in connection with the death of BJP leader Sonali Phogat.
The court said demolition could "certainly go on" in case of any unauthorised construction in lands other than the particular survey number.
The court listed the case for September 16 and directed the Goa Coastal Zone Management Authority to file its response by September 14.
The Authority was asked to enclose all the reports in connection with the matter as well as the pictures and plans.
