The defense is attempting to establish that while Biden may have been abusing alcohol, there is no clear evidence of drug use at the time of the firearm acquisition in October 2018. Attorney Abbe Lowell highlighted a payment made by Biden at a liquor store in October 2018, suggesting a focus on alcohol consumption rather than illegal drugs.
Interestingly, the federal gun forms inquire about illegal drug use or addiction but do not address alcohol consumption. Lowell emphasized that according to the current regulations, a person under the influence of alcohol could still legally purchase a firearm.
Lowell further pointed out multiple liquor purchases made by Biden in Wilmington during the same month he bought the gun, reinforcing the defense's argument regarding alcohol use versus drug addiction.
