This creates a significant gap between the global nature of digital assets and the fragmented structure of national legal systems.

The scholarly research of Vladyslava Trach is aimed at bridging this gap through the development of a comprehensive legal and technological model for managing digital assets in inheritance relations.

The research applies systemic, comparative legal, analytical, and information-technology approaches.

The scientific novelty of the article lies in the development of a conceptual model of a notarial information system designed to provide automated registration of digital assets, verification of authenticity, secure storage, and transfer to heirs through integration with state registries, financial systems, and blockchain networks. The author substantiates the necessity of establishing a specialized digital infrastructure for the notarial system as a strategic direction for the development of Ukraine’s legal framework.

This publication establishes the institutional foundation for further algorithmic solutions in the field of digital inheritance.

Cross-Border Compatibility as a Central Challenge of Digital Inheritance

On February 11, 2026, U.S. Provisional Patent Application No. 63/980,596 was filed for the invention entitled “Computer-Implemented Notarial Method and System for Secure Collection, Processing, and Transfer of Digital Assets to Heirs Using Artificial Intelligence.”

The application describes a computer-implemented system integrating modules for digital asset collection, notarial verification, algorithmic modeling of inheritance scenarios, and mechanisms ensuring cross-border legal compatibility. Accordingly, the research outcomes have been translated into technological implementation within the U.S. patent framework.

International Significance of the Research

The research of Vladyslava Trach is directed toward the formation of a new legal architecture for managing digital assets in the international environment. It contributes to the harmonization of inheritance procedures, enhancement of legal certainty, and protection of the rights of digital asset owners and their heirs.
