Martin Vargas Arellano was no longer officially in Immigration and Customs Enforcement custody when he died. ICE had released the 55-year-old Mexican immigrant from detention three days earlier, even though he was comatose and had already been declared brain-dead, according to a lawsuit filed by his son.
Five years later, a federal jury could decide whether the private company running the detention center bears responsibility for the chain of events that preceded his death.
