CCTV played at ex-NRL player's rape trial

A woman allegedly raped by former NRL player Tristan Sailor was cuddling, kissing and laughing with the man in the hours before, CCTV played in court shows.

Tristan Sailor is accused of having sex with the 24-year-old while she was either unconscious or too drunk to consent after a night out with friends in October 2020.

Sailor, now 23, has pleaded not guilty to two rape charges and maintains the sex was consensual.

In four hours of CCTV footage played over several days, the jury watched the woman having bottomless margaritas and tacos with a friend at Carbon Mexican Woodfire in Bondi, before they met up with a group of Sailor's teammates for drinks at another Bondi venue.

At different points during the evening, the footage shows Sailor and his alleged victim hugging, kissing and laughing together.

At about 8.15pm the pair left the Beach Road Hotel, catching an Uber to the alleged victim's Wolli Creek apartment with two others.

An hour-and-a-half after the men arrived, Sailor was captured leaving the building with his friend on CCTV, carrying his socks and shoes.

What happened in that 90 minutes is a central question for the jury.

The Crown says the woman remembers taking two sips of her drink and nothing else before waking the next morning, naked and bleeding in urine-soiled sheets.

However, Sailor's barrister Richard Pontello has told the jury that the woman was conscious and consenting the entire time the pair were having sex - even if she doesn't remember it.

The trial will continue next week.
