CHANDIGARH: The Punjab and Haryana high court has held that a complainant cannot be extended leverage to an extent that all persons named by him should be prosecuted despite absence of any material. “Such a proposition, if accepted, would vest unbridled authority in a complainant to array any number of accused and to claim their prosecution irrespective of any material to link and establish their association with the establishment sought to be prosecuted,” the HC has held.
Justice Vinod S Bhardwaj of the HC has passed these orders, while dismissing a petition filed by provident fund (PF) inspector challenging the order dated February 6, 2018 passed by a local court in Bhiwani. In its February 2018 orders, the Bhiwani court had discharged the management of the Baptist Senior Secondary School in Bhiwani from prosecution on the basis of the complaint filed by the PF inspector.
