Brothers jailed for 'cowardly attack' on vulnerable man amid row over mobility scooter

Two vile brothers who beat a vulnerable disabled man in a row over a stolen mobility scooter have been jailed.

Gareth Leach, 28, and his half-brother Kyle Martin, 22, were locked up for nine years for the killing of Dean Williamson as he waited on his mum's doorstep for her to return home on October 5 last year.

Both were acquitted of murder following a trial last month but admitted manslaughter.

Martin pleaded guilty at a pre-trial hearing and Leach did the same at trial.

Sheffield Crown Court heard on Monday that Mr Williamson - who suffered problems with his lungs - was attacked outside his Parkgate house after stealing a mobility scooter belonging to Sara Martin, the mum of the two brothers, reports Yorkshire Live.

Prosecutor Peter Heath Glenser QC told the court that on September 29, Mr Williamson was spotted on CCTV taking Sara Martin's mobility scooter.

On October 5, Leach was on his way to build a secure unit for the scooter when he saw Mr Williamson, 45, waiting for his own mother outside his house.

The pair had a conversation and Leach left to continue the task of making a safer place for a scooter.

He was later joined by Martin, of Selwyn Street, Rotherham, who went to attack Mr Williamson.

Leach, from Mexborough, followed and rained stamps on Mr Williamson, who had already been assaulted by Martin and was on the floor.

Mr Williamson's head was "dashed" against a wall and he was kicked with a "shodfoot" to his body and head.

Mr Heath Glenser said: "The confrontation lasted a few seconds.

"The Crown say both men seriously assaulted Dean Williamsopn and he died as a result of his injuries."

Mr Williamson was rushed to Rotherham District General Hospital where he died the same day.

Leach - a dad-of-two - was interviewed on October 6 and handed over a pre-prepared statement that said Martin was the person responsible.

His mother, Sara Martin, was also interviewed as a witness and provided an account supporting Leach's.

However, a search of Leach's white Picasso revealed dashcam footage which captured him asking his mother to support his account.

On the footage, he could be heard saying: "I've just killed him. Me and Kyle.

"We left him with broken ribs. I had to pull Kyle off him before he killed him.

"I threatened him and Kyle came and said, 'where is he?'

"He went and shouted, "I don't know what came over me...killed him. I had to get Kyle off, I thought he was going to kill him, literally kill him.

"I didn't put my fists on him so there's no evidence...told me he'd bought it off someone. I said, 'I have got you on CCTV.'

"I told you didn't I, I told you. I knew it was a bad idea going today."

In another conversation between the two that took place after mobile phone analysis showed Ms Martin had called her younger son, Leach can be heard saying: "Tell them it's Kyle not me. I've got kids mum.

"I'm going to lose my kids, I'm going to lose everything. You have got to tell Kyle not to mention me."

Sara Martin was handed an 18-month sentence suspended for two years for perverting the course of justice.

In an interview with police following the discovery of the footage, Leach exercised his right to remain silent.

Kyle Martin was arrested on October 7 and remained silent during his interview but had made earlier remarks to a police officer about being responsible for violence and the death of Mr Williamson.

Mr Heath Glenser told the court Leach has no previous convictions and Martin had three for five offences - with just one public order offence committed as an adult.

Mitigating for Martin, Francis Victor Burg-Edusei, told the court he had acknowledged his guilt and responsibility in his part of the offence "right at the beginning and continued right through to the Crown court."

He added that over the last two years, Martin had turned his life around and was no longer committing offences until October 5.

For Leach, Abdul Shafaq Iqbal QC said he suffers with depression and anxiety that has before resulted in a serious attempt on his own life.

He said that prior to Mr Williamson's killing there was "no activity on the part of Gareth Leach to try and take revenge on anyone" for the theft of the mobility scooter, and in the conversation with Mr Williamson on October 5, there was "no telling or warning of it and it didn't lead to any physical interaction between the two."

The court was told Leach and Martin were "not particularly close" as half-brothers and "don't even seem to have the numbers of the other stored in their phones."

Mr Iqbal added: "Gareth Leach wants to apologise to the family of the victim.

"He told the author of his pre-sentence report that he understands the impact on them is immeasurable and he wants to apologise.

"He appreciates he must serve a period of incarceration and the impact on his mum, his partner and two children [that will have.]"

Mitigating for Sara Martin, Ian Herbert West, told the court she acted "out of sympathy to her grandchildren - Gareth Leach's children."

As he sentenced all three, The Honourable Mr Justice Robin Knowles CBE said: "This is a depressing case and one that is not without its complexities.

"The foolish theft of a disability scooter by a disabled man from a disabled woman led to a cowardly attack on the deceased by two able-bodied men.

"It was started by Kyle Martin and Gareth Leach joined on.

"The vulnerability [of Mr Williamson] was known to both attackers, but not his vulnerability through illness.

"Although Gareth Leach didn't start the attack, when he joined the victim was on the floor, already in a bad way."
