Edward Wogrowski, a forensic crimes expert, provided testimony regarding some of these texts. One particular message from Ethan read, 'The house is now haunted. And then what? Some weird shit just happens and now I'm scared. I'm just going to be an outsider for a while. Can you at least text back?' The last message was sent at 6:29 p.m. on a specific day.

Notably, Jennifer Crumbly's response to her son's distressing texts did not come until two days later, at 4:11 p.m., when she asked about the whereabouts of Ethan's father. Another text message surfaced, sent by Jennifer to her husband a few hours earlier, in which she mentioned her intention to get drunk and ride her horse. The judge allowed this message to be included as evidence, suggesting it demonstrated Jennifer's lack of intent to help her son when he needed her most.

In addition to the text messages, the defense has expressed an interest in having Ethan Crumbly take the stand to refute the allegations made against him. They argue that in interviews with a forensic psychiatrist, Ethan admitted to lying about many of the texts and their meaning. However, the appellate attorneys involved in Ethan's separate appeal, which seeks to contest his sentence of life in prison without parole, have asserted that he will invoke his privilege against self-incrimination by pleading the fifth if called to testify. Consequently, the judge has expressed reluctance to allow Ethan to take the stand under those circumstances.
