MUMBAI: Bombay high court on Tuesday held that the disqualification of Tata Motors by BEST for its e-bus tender was correct, but in a set back to the civic transport undertaking and the winning bidder, it also scrapped the award given for the 2100 buses to Evey Trans Pvt Ltd, as being "incorrect'' and directed that the undertaking may hence, call for fresh bids, if required.
The HC pronounced its judgment on a petition filed by Tata group company which had challenged its disqualification by Brihanmumbai Electric Supply and Transport (BEST) undertaking for being ‘technically non-responsive’ and took exception to the contract being awarded for 2100 e-buses to another bidder—Evey Trans Pvt Ltd-- as being contrary to tender conditions.
