Australian-first right enshrined into ACT law

New laws will give people the power to complain about failures to protect and maintain the environment in the ACT.

The right to a healthy environment has been enshrined in the ACT's Human Rights Act, which recognises the right to clean air, a safe climate and access to safe water.

The ACT is the first jurisdiction in Australia to recognise the right to a healthy environment.

Under the laws, environmental and climate considerations must feature in public authority functions and decision-making.

People who feel their rights have been breached will be able to complain to the ACT Human Rights Commission.

But complainants won't be able to pursue breaches in the ACT's highest court with the government stopping short of the recommendation put forward in a parliamentary inquiry to allow the Supreme Court to hear complaints.

The right will come into place in six months, with the government saying this time will be needed for public authorities and directorates to fully understand and implement the right in decision-making and policies.

Human Rights Minister Tara Cheyne said the bill was significant.

"It demonstrates the commitment of the ACT government to ensure our environment is protected for Canberrans of the present and future," she said.

"There is a growing body of national, regional and international law that recognises the close relationship between human rights and the environment."

Environment Minister Rebecca Vassarotti said the move ensured climate action was a responsibility for all future governments.

"This decision is crucial for protecting the future of our planet, especially for the younger generations," she said.

"My hope is that the ACT government's leadership will set a precedent, inspiring other states, territories, and countries to follow suit."
