ATLANTA — The federal appeals court in Atlanta on Thursday ruled that U.S. Sen. Lindsey Graham must testify before the Fulton County special purpose grand jury investigating former President Donald Trump and his allies for possible interference with Georgia’s 2020 elections.
The South Carolina Republican’s lawyers had asked the court to issue an emergency stay on the special grand jury proceedings so Graham’s appeal of a judge’s order that he be required to testify could be fully considered. But a three-judge panel of the 11th U.S. Circuit Court of Appeals flatly denied it, stating that Graham had “failed to demonstrate that he is likely to succeed on the merits of that appeal.”
The six-page decision was jointly authored by Judges Charles Wilson, an appointee of President Bill Clinton, and Judges Kevin Newsom and Britt Grant, both of whom were appointed by Trump.
