Armed man 'spin-kicks' and beats woman after storming into pizza takeaway

A thug threatened a woman with a hammer and 'spin kicked' her in the stomach before screaming racist abuse at police, a court heard.

Police were called to Mama G Pizza on Ashworth Street in Denton where James 'Jimmy' Webster, 39, was wielding a hammer, on October, 18, 2021.

Prosecuting at Minshull Street Crown Court, Huw Edwards, said officers demanded him to drop the weapon, which he did, and he was subsequently restrained and arrested.

Mr Edwards said officers saw a woman lying on the ground. She had no visible injuries but informed officers she has been kicked to the stomach by Webster and was in pain.

The woman's ex-partner informed officers that he had been having ongoing issues with the defendant.

He also informed officers that earlier in the day, Webster attended the takeaway, opened the door and shouted abuse towards him and staff, which he reported to police.

Mr Edwards said the man was in the back room of the takeaway tidying up when Webster returned at approximately 5pm on the same day.

He came to the front counter and his former partner, who was also in the takeaway, asked Webster to calm down and leave.

CCTV footage showed that In response, Webster ‘spin-kicked’ the woman to the stomach.

He also grabbed her by her hair and banged her head on the ground.

Webster, currently of no fixed abode, then shouted abuse towards the woman's ex partner, picked up a chair and threw it in his direction, hitting him, before fleeing.

The assault was witnessed by members of the public .

Mr Edwards told the court that after Webster's arrest, while he was sat in the police vehicle, he called one police officer a ‘ fat t**t” and told another that he will ‘spit on his face’ and that he is ‘HIV Positive’.

He referred to another police officer as a ‘P**i’ a “P**i b*****d’ and a ‘P**i c**t.’

As a consequence, Webster was further arrested under the Public Order Act

In a statement read out in court, the woman said: I already had issues with going out due to being stabbed in the past.

"I have only just regained the confidence to start going out and about but this now has made me think is it worth it.

"He has taken away my faith in humanity. "

The male complainant said: "I am convinced that Jimmy will come back, I am very concerned for my business and my staff.

"Jimmy intimidates me and I am concerned for my safety.

"I don't want to have to react as that concerns me.”

Defending, Phillip Boyd said Webster, who has a previous history of assault, had not offended in seven years, had expressed his apologies for his actions and had pleaded guilty to assault, possession of a weapon in a public place and using racially aggravated behaviour and words with an intention to cause harassment, alarm and distress, at the first opportunity.

He said Webster had found gainful employment but had lost his job due to the pandemic and also had a drug addiction, which had contributed to his behaviour.

Sentencing, Recorder Cox described the attack and abuse as "abhorrent."

He said of the female complainant: "She was recovering from stomach surgery and this caused an immense amount of fear."

He sentenced Webster to a total of eight months imprisonment.
