Appeals Judges Question Louisiana's Legal Standing as Mail Access to Mifepristone Stays in Place Nationwide for Now

Developing Story Note: This report covers new developments in Louisiana's lawsuit challenging FDA rules that allow mifepristone to be prescribed through telehealth and mailed. Information may change as courts and regulators act. Latest verified development: 5th Circuit oral arguments held Sept. 9, 2026.

A three-judge panel of the 5th U.S. Circuit Court of Appeals appeared skeptical on Sept. 9 that Louisiana has the legal right to challenge a federal rule allowing mifepristone to be prescribed through telehealth and delivered by mail. The hearing produced no ruling, and nothing changes for patients today. Telehealth prescribing remains permitted under federal rules because the U.S. Supreme Court stayed an earlier order that would have blocked it.
