Hospitals and the federal government disagree sharply over what the new 340B rebate pilot will cost. The American Hospital Association (AHA) and other plaintiffs say the program could add more than $1 billion a year in administrative costs, while the Health Resources and Services Administration (HRSA) estimates about $537 million a year, Fierce Healthcare reported.
That gap is at the center of a new lawsuit. The AHA, the Maine Hospital Association, and four safety-net hospitals sued the Department of Health and Human Services (HHS) and HRSA on Oct. 9 in the U.S. District Court for the District of Maine, asking a judge to block the pilot before it begins on Jan. 1, 2027. Three drugmakers and their trade group have since moved to join the case.
